TMZ reports that Kim Kardashian and Kris Humphries are both willing to annul their marriage, but neither of them is willing to admit to fraud.
In California, a person seeking an annulment must prove that the marriage was procured through fraud or that one of the parties lacked the physical or mental capacity to enter into the marriage. Annulments based on fraud usually must relate in some way to the sexual, procreative, or child-rearing aspects of marriage.
According to TMZ, Kardashian wants Humphries to admit that he promised to live with her in Hollywood but never intended to do and instead planned on living in Minnesota. As part of his fraud claim, Humphries wants Kardashian to admit that she never intended for them to have a real marriage.
It is also rumored that Humphries has demanded that Kardashian pay him $7 million to settle their divorce. Kardashian has reportedly refused on the grounds that Humphries made money off their wedding and signed a prenuptial agreement.
