A Pennsylvania appellate court has upheld a lower court’s ruling awarding a woman frozen fertilized eggs that her ex-husband wanted destroyed.
Lynn Reis and Bret Howard Reber underwent in vitro fertilization in late 2003 after she was diagnosed with breast cancer. Using his sperm and her eggs, the procedure resulted in 13 pre-embryos.
Mr. Reber subsequently filed for divorce in 2006 and fathered a child with another woman. Due to concerns about her future ability to have children, Ms. Reis sought the frozen embryos in the couple’s divorce proceedings in Chester County.
In May 2011, the trial court awarded the embryos to Ms. Reis. The court said in its decision, “Because Wife cannot achieve genetic parenthood otherwise, we conclude that Wife’s interest in biological procreation through the use of these pre-embryos outweighs Husband’s professed interest against procreation.”
The appellate court affirmed the lower court’s decision and rejected Mr. Reber’s argument that he was essentially being forced to “procreate” with his ex-wife. The court noted that the case could have been avoided had the couple signed an agreement on what to do with the frozen embryos in the event of divorce or the death of one of the parties.
Ms. Reis promised not to seek child support against her ex-husband in the event that any of the embryos in born, but the appellate court noted that her promise was not legally binding.
